EUROPEAN PATENT
SYSTEMS

In Europe, there are two patent systems available to applicants: the Unitary Patent System and the European Patent Validation. Both systems allow applicants, stand-alone or in combination, to simplify the filing of their patents in the chosen member states of the European Union or the European Patent Convention.

European Patent Validation

Once it has been granted, a European Patent has the same effect in each of the countries for which it is granted as a national patent subject to the laws of that country.

With a single estimate for all the countries chosen, a system for consulting intellectual property agents specializing in European Patents, and the overall management of the necessary translations, this process brings you cost savings and validation in the quickest, easiest, and most effective manner possible.

Unitary Patent

SHIP Global IP offers centralized solutions for European patents with unitary effect, saving you time and reducing administrative tasks and costs

Once granted, a Unitary Patent has unitary effect in each of the participating EU member states subject to the jurisdiction of the Unified Patent Court.

SHIP's Unitary Patent Service facilitates your unitary patent needs with a comprehensive service that among others includes translations, UP filings and renewals streamlined by our specialized intellectual property management system. Saving you time and reducing administrative tasks and costs.

UPC Opt-out service

With the Unitary patent system coming into force on June 1, 2023 all European patents and applications in the participating EU member states will automatically come under the jurisdiction of the Unified Patent Court.

Patent owners who wish to keep their European patents in the jurisdiction of the respective national courts have been given a transitional period of at least seven years by the EPO during which they can opt-out their patents from the UPC.

SHIP offers streamlined, cost-effective and secure UPC opt-out services for all portfolio sizes covering ownership audits and filings among others.
