EP Validation is the process of converting a granted European Patent Application into a national patent in one or more of the 39 contracting member and extension states of the European Patent Convention.

The validation process typically involves the translation of all or part of the patent, depending on whether the country has ratified the London Agreement, the payment of fees, and the filing of documents within three months from the European Grant Date.

When the European Patent Office (EPO) accepts the potential granting of an application a series of steps must be taken for the European Patent to become valid in the different countries.

The validation stage has two different phases:

Phase 1 Acceptance of the patent granting, which must happen within four months of reception of the intent to grant the patent

  • It consists of:
  • Paying granting and publication fees
  • Translating the claims into English, French or German (both languages must be different from the language in which the patent was originally written)
  • Submitting the translation of the claims to the European Patent Office

Phase 2 Validation of the patent in each designated country

  • It comprises:
  • Translating the patent and submitting the translation
  • Paying the official validation fees
  • Submitting the translation, if necessary
